K-2
Children
For your interview, make sure you have the
Passport and Birth Certificate of your children
no matter their age. If the foreign father is on
the Birth Certificate she will need to get an
affidavit from the foreign father releasing his
paternal rights. If he is unavailable
Philippines law allows for a parent to take a
child out of the country without an Affidavit
from the absent foreign father (unless the
father has legal custody).
Minor children who are identified and listed in
the approved I-129F petition may follow-to-join
their petitioned parent. However, such
follow-to-join K-2 visas can only be issued
within one year from the time the parent was
issued the K1 visa. After one (1) year, they
will no longer be able to derive immigration
benefits from the I-129F petition and you or
your spouse will have to file an immediate
relative or second preference petition for them
to qualify again for immigration benefits.

I-864 Affidavit of Support
In
the interest of "full disclosure.. .," the
I-864 obligation is terminated by death of
the sponsor or beneficiary or a permanent
return of the beneficiary to his country of
origin.
It's also fair to repeat that a divorce and
remarriage of the beneficiary will not
terminate the I-864 obligation.
In Family Law courts, beneficiary spouses
routinely try to introduce their I-864
documents as evidence that the sponsor must
provide support. The only resulting court
decisions (that I have found) in recognition
of the I-864
force has been to allow the beneficiary
spousal support in the difference between
her documented earnings and the 125% of
"poverty level" amount. |

Why do you want to marry a Filipina?

Do you think she will be a
submissive Asian woman? Filipina's are
not submissive.
You choose a women from
another country for a reason, don't forget
that. You choose a Filipina because they
have many qualities that you admire.
Remember this when: She is cooking very
stinky food at home. She talks on the phone
all the time to friends and family. She
doesn't like your food. She wants to send
money, clothes, and varies items back home
to help her family. She wants to work to
earn money to send back home. She wants to
go to church. She wants to have a baby or
two. She is pouting a lot, giving you the
silent treatment, hot tempered. She wants to
reorganize the entire house because you have
no idea what you are doing. She's very
jealous and you had better watch yourself.
Your lady is not like this
huh? I have news for you, she's more like
this than you know. You don't really know
someone until your married and living
together for awhile.
Filipinas are great, loving,
and devoted wives but they are from another
world and always will be. After all, that's
part of their appeal isn't it?
