Q: Can a K-3 Visa Holder Work in the United States?

Answer:

As a K-3 visa holder, you can file form I-765, Application for Employment Authorization with the USCIS that serves the area where you live for an employment authorization document (work permit).

 

 

Children Have Derivative Status

Children do not need separate Petition for Alien Relative, I-130 petitions, but you, the petitioner, must take care to name all your children on the Petition for Alien Fiance, I-129F petition. If you do not name the children on the petition, they may find it difficult to prove their identity as children of a K-3 applicant or person in K-3 status.

You must file separate I-130 immigrant visa petitions for your children before they qualify for permanent residence. When they adjust status in the United States, they must file Form I-485 Application to Register Permanent Residence or to Adjust Status with the USCIS Office that serves the area where you live. Remember that in immigration law children must be unmarried and under 21 years of age.

Q: Can my fiancee from the Philippines get a tourist visa to the United States and we marry here or will it satisfy the having met in-person requirement?

Answer:

 It's almost impossible for a Filipina to get a tourist visa to the U.S.

A tourist visit cannot be converted to a K1 fiancee visa nor can it be converted to a K3 Spousal visa and if they find out that she used a tourist visa to come to the U.S. with the intension of marrying you or becoming engaged to you, then she will have committed immigration fraud and possibly be banned from the U.S. forever. The best way to do this is to go there and meet her face to face, then we can file and get her a K1 visa fast.

Q: I am getting ready to go meet my fiancee in the Philippines, can I sign up now and get the paperwork started to save time?

Answer:

Absolutely! It is an excellent idea to have your papers ready as soon as possible, when you meet her, she can sign and date her papers and give you copies of the documents you need from her. Q:  Do my children need to attend the visa interview?

Answer:

  • Yes, unless your children are already U.S. citizens. Children, regardless of age, who are applying for immigrant or derivative fiance(e) visas, must attend the interview.

Q: Can I pick-up my shipment from the DELBROS office?

Answer:

  • Pick-up is not allowed by the company. All shipments released by the Embassy will be delivered to the consignee on a specified timeline committed by DELBROS, Inc. to the Embassy.

Q. Does the American Consulate that will issue the K-3 Visa have to be in the Country where we were married?

    Answer:

    Yes, the regulations state that applicants for the K3 and K4 visas must apply for those visas in the country where the marriage to the US citizen took place. However, there are 2 exceptions to this rule:

      1) If the marriage took place in the US, then the visa application must take place abroad in the country where the visa applicant resides.

      2) If the marriage took place in a country where there is no US consular section providing nonimmigrant visa services, then the application for a visa shall take place in the country designated by the Department of State for immigrant visa processing for residents of the country where the the wedding took place.

 

Q: Can I authorize another person to receive my Visa?

Answer:

  • Yes. You may authorize any person of legal age to receive your passport. Thus, in the absence of the consignee, an authorized representative may claim the shipment provided that a Letter of Authorization and valid IDs of both consignee and representative are presented.

Q: Can I request DELBROS for a specific time of delivery?

Answer:

  • DELBROS delivery time is between 8:00 am to 5:00 pm only. No definite time.

Q: Can I please request DELBROS to follow up the status of my visa from the Embassy?

Answer:

  • Delbros, Inc. was contracted by the Embassy to provide delivery services only. Delbros personnel are not allowed to follow-up/facilitate the processing of Visa with the US Embassy or any of its personnel.

The fastest way to get your fiancee working after she gets here is this:
 
  1. Get Married.
  2. Get a certified copy of your wedding certificate.
  3. Go to the Social Security Office and apply for her Social Security number with her I-94.
  4. Go to the DMV and get her a state ID card with her I-94.
When she receives her Social Security number and her state ID card in the mail she will be ready to work. You must file her Adjustment of Status later. Now of this will work if her I-94 expires, so you only have 90 days from the day her K-1 visa is issued to do steps 1-4.

Once her I-94 expires, she will need to file her Adjustment of Status before she can get a Social Security number or a state ID card. So move fast if working is a priority!
