Adjustment
of status is the process of obtaining legal permanent residence in
the U.S. The adjustment application is filed with the Department of Homeland
Security to get what is known as a green card.
After your love one has been admitted
to the United States as a Fiancée your marriage must take
place within the 90-day time limit. Following your marriage, your
wife MUST apply to the USCIS to adjust her status from
nonimmigrant status to conditional permanent residence status. At
that time she can apply for work authorization also which will
give her a temporary "GREEN CARD".
You may apply to adjust your status if:
Based on being the spouse or child of another
adjustment applicant or of a person granted permanent residence.
You may apply to adjust status if you are the spouse or child of
another adjustment applicant, or of a lawful permanent resident,
if the relationship existed when that person was admitted as a
permanent resident in an immigrant category, which allows
derivative status for spouses and children.
Based on admission as the fiancée of a U.S.
citizen and subsequent marriage to that citizen. You may apply to
adjust status if you were admitted to the U.S. as the K-1
fiancée of a U.S. citizen and married that citizen within 90
days of your entry. If you were admitted as the K-2 child of such
a fiancée, you might apply based on your parent's adjustment
application.
How Long Is The I-485 Valid?
The I-485 permanent residence is valid indefinitely, as long as
permanent residence is not abandoned through absence of six
months or longer from the U.S.
Are Dependents Eligible for I-485?
Each person that desires permanent residence must file a separate
I-485 application.
The I-485 adjustment process involves the
investigation of an individual's identity, health, criminal
background, and the ability to support him or herself in the
United States. The employment-based adjustment applications must
be filed at a USCIS Service Center. The family-based adjustment
applications are filed at a local USCIS district office.
An approved or concurrently filed visa petition allows a
qualifying person to submit applications for registration, employment
authorization, and travel permission, along with proof of financial support. The
process involves filing the petitions and applications with supporting
documents, getting fingerprinted, attending an interview, and answering any
requests for additional evidence issued by the Department of Homeland Security
or other agencies.
